Under certain laws, IAEG is required to rely on one or more lawful grounds to collect and use the personal information that IAEG has outlined above. IAEG considers the grounds listed below to be relevant:

        1. Legal obligation

Where the processing of your personal information is necessary for IAEG to comply with a legal obligation to which IAEG is subject e.g. because IAEG has to provide information to tax authorities.

Where it is necessary for IAEG to use your personal information in order to perform a contract to which you are a party (or to take steps at your request prior to entering a contract).

        1. Legitimate interests

IAEG relies on this basis where applicable law allows IAEG to collect and use personal information for its legitimate interests and the use of your personal information is fair, balanced and does not unduly impact your rights. For instance, it is in IAEG’s legitimate interests (and those of IAEG’s members) to use personal information in association with the undertaking of an audit .

When IAEG processes your personal information to achieve such legitimate interests, IAEG considers and balances any potential impact on you (both positive and negative), and your rights under data protection laws. IAEG will not use your personal information for activities where IAEG’s interests are overridden by the impact on you, for example where use would be excessively intrusive (unless, for instance, IAEG is otherwise required or permitted to by law).

        1. Consent

IAEG may obtain your consent to use your personal information in certain circumstances e.g. to send you email marketing. IAEG will ensure that when it obtains your consent, you are free both to give it and to decline to give it.

  1. International Data Transfers

Certain countries have rules around the transfer of personal information across borders and require IAEG to ensure that personal information remains protected according to appropriate standards (for example, EU Member States under the GDPR).

Since IAEG is based in the US, personal information collected in the EU will be transferred outside the EU to IAEG in the US.

If you are an individual based in the EU, please note that certain countries outside of the EU have a lower standard of protection for personal information, including lower security requirements and fewer rights for individuals. In such cases, where your personal information is transferred, stored, and/or otherwise processed outside the EU in a country which does not offer an equivalent standard of protection to the EU, IAEG will take all reasonable steps necessary to ensure that the recipient implements appropriate safeguards (such as by entering into standard contractual clauses) designed to protect your personal information and to ensure that your personal information is treated securely and in accordance with this Notice.

If you have any questions about the transfer of your personal information, please contact IAEG using the details at section 13.

As a result, IAEG cannot and does not guarantee the security of any personal information you transmit to IAEG, including through or in connection with the website.

If you believe that your interaction with IAEG is no longer secure (e.g. you consider that the security of any account you might have with IAEG has been compromised) please immediately notify IAEG by using the details at Section ** below.

  1. How long does IAEG keep your personal information?

In some jurisdictions, there are limits on how long IAEG may retain your personal information. Where these limits apply, in general, unless still required in connection with the purpose(s) for which it was collected and/or processed, IAEG removes your personal information from its records within 5 years after the date it was collected. However, if before that date (i) your personal information is no longer required in connection with such purpose(s), (ii) IAEG is no longer lawfully entitled to process it or (iii) you validly exercise your right of erasure (please see section 10 below), IAEG will remove it from its records at the relevant time.

Where necessary IAEG will keep your personal information:

        1. to comply with any statutory or regulatory requirements IAEG is subject to under applicable law; or

If you have any questions about the retention periods for holding your personal information, please contact IAEG using the details at section 13 below.

In any case, these are legal rights which apply subject to exemptions.

        5. Object to the processing of your personal information where IAEG: (i) processes on the basis of the legitimate interests ground; (ii) uses the personal information for direct marketing; or (iii) uses the personal information for statistical purposes.
        6. 7. Ask for processing of your personal information to be restricted if there is disagreement about its accuracy or legitimate use.
